House Bill 18-1126: Regulation of Dogs in Common Interest Communities

Yesterday, I provided a summary of legislative bills that may affect common interest communities.  House Bill 18-1126 is proposing an amendment to 38-33.3-106.5 of CCIOA that would prevent an association from enacting a prohibition against:

“The keeping of certain types of dogs based solely on a breed, weight, or size classification.”

The Bill, however, still permits some forms of regulation as follows:

“An Association may regulate the number of dogs per household and may enforce covenants concerning dog or owner behavior, including nuisance barking, waster disposal, and other matters.”

Stay tuned to future blog posts that will discuss additional significant proposed legislation affecting common interest communities.
