Covid-19 Immunity Proposed: Does it Apply to Associations?

House Bill 21-1074 was introduced on February 16, 2021 and proposes to provide immunity from civil liability to certain entities, including common interest communities.

The Bill current proposes civil liability immunity for “any act or omission that results in exposure, loss, damage, injury or death arising out of COVID-19”. To qualify, a business (association) must take good faith efforts to comply with applicable public health guidelines together with other guidelines and mandates issued by the State of Colorado and its agencies.

It is worth keeping a close eye on this proposed Bill to see if it obtains further traction given that Covid-19 liability has been a huge concern for associations since the pandemic began.
